The Office of the Illinois Secretary of State maintains your driving record.  Your complete driving record contains a history of convictions, dispositions of court supervision, any failures to appear in court, failures to pay required fines, and any prior suspensions or revocations of your driver’s license.  Something as fundamental as your ability to legally drive depends on the condition of your driving record.

Illinois views driving as a privilege, not a right.  There are many situations in which this privilege can be temporarily or permanently taken away from you.  For this reason, your approach to what might seem to be even the most routine traffic ticket should not be taken lightly.

When defending a traffic case, this office takes great pains to determine how any possible outcome can affect your driving record.  The goal, however, always is simple: to keep you on the road and your driving record as clean as possible.

There is no "Routine Moving Violation"

Many people come to Matthew T. Hoffman P.C. a few days after they were pulled over for a "routine moving violation."  They can’t believe that during their "routine" traffic stop the police officer actually placed them into handcuffs.  They were handcuffed because the officer informed them they were driving on a suspended license. Yet they had no idea this was the case.

Following the advice of a police officer, who writes you a ticket and tells you that if you mail in your fine, you won’t have to go to court, can lead to problems on your driving record.  The problem is that nowhere on your ticket are you informed of the possible pitfalls of handling your case this way.  Nor is the officer required to explain those hazards to you.

As an Illinois motorist, you remain under the watchful eye of the Office of the Illinois Secretary of State.  How you handle your current moving violation can make its way to your driving record.  If your driving record records enough convictions, you can temporarily, and even permanently, lose your right to drive.

Suspended License? Get Back on the Road.

The Office of the Illinois Secretary of State can suspend or revoke your driver’s license for many different reasons.  Some of these are:

  • if you are over age 21, and are convicted of any 3 moving violations committed during a single year;
     
  • if you are under age 21, and are convicted of any 2 moving violations committed during two full years;
     
  • if you have repeatedly been involved in traffic accidents;
     
  • if you have been convicted of leaving the scene of an accident;
     
  • if you have been convicted of driving without insurance;
     
  • if you have failed to pay traffic fines you were previously ordered to pay by the courts;
     
  • if you have previously failed to appear in traffic court as required;
     
  • if you have been convicted of underage consumption or possession of alcohol; and
     
  • if you have been convicted of DUI.
